The constitutional precept, the location of the fundamental right and the judicial decision

The hierarchy of the constitutional precept, the axiological sense of the fundamental right and the operative and coercive capacity of the judicial decision are articulated allowing to identify the fullness and force of the source, its content, the specific orbit of a right labeled as superior and the possibilities of justice within reach of a judicial operator endowed with investiture by the jurisdiction, that is, society builds an order, establishing precise rights and entrusting a determined state power to resolve on them. This projection confirms the will of a political community towards the search for an acceptable social coexistence, for which it decides to constitute an order of superior characteristics that consequently must print a gravitational force to each citizen and to the configured institutionality, so that the proposed equation, constitutional precept, fundamental right and judicial decision is presented as a specific path endowed with opportunities for realization because it is direct and binding.
