The transhumanist premise of achieving the improvement of human capabilities beyond their natural limits through technology is intrinsically related to Artificial Intelligence, which constitutes one of its main instruments. Thanks to it, interventions such as the implantation of brain electrodes, which until now only had therapeutic purposes, are on their way to gaining importance
as methods for improving physical, cognitive and memory abilities. Given the imminence of such advances, it is necessary to identify the inequalities that they may cause. For example, coexistence with people who have used this technology to enhance their capabilities would lead to unfair competitiveness in areas such as academics or work. Something similar has been happening for years in elite sporting events, which face the challenge of the use of anabolic steroids that affect equal competition.
The objective of this work will be to present the current situation of Artificial Intelligence with transhumanist and posthumanist purposes to elucidate whether its complete implementation is compatible with fair competitiveness in the aforementioned areas. In this way, the challenges that democratic societies face when addressing the legislative regulation of these circumstances will be identified, both in relation to the content of this regulation as well as its form and even its mere existence.
