Abstract

Several issues were analyzed and discussed around the debate between transhumanism and bioconservatism, in terms of ethics, innovation and law, since these two positions of thought constitute currents that represent opposing views on human evolution and the use of biotechnology in man, where on the one hand, transhumanism is summarized in the idea of improving human capabilities through scientific advances, On the other hand, bioconservatism appeals to a concept of conversation of the authentic human nature and the individual attributes of the subject, warning about the dangers and ethical and social consequences of human enhancements. The development of this research has been carried out through a qualitative approach to research, and a mixed legal methodology, which is both dogmatic and philosophical, employing the method of critical analysis, and applying the state of the art and documentary literature review as research techniques. From this, it was concluded that it is necessary to frame scientific innovation within an ethical and legal framework guided by fundamental principles and human rights, since the excessive and utilitarian use of these technologies on human beings can lead to serious social consequences with serious negative repercussions on fundamental rights and human dignity.
